These terms are an agreement between you and HooRaise LLC ("HooRaise", "we", "us"). By creating an account, joining a campaign or making a donation, you agree to them.
1. What we do
HooRaise provides software that lets schools, teams, clubs and other groups ("organizations") run online fundraising campaigns. We are not the organization raising money, we are not a charity, and we do not guarantee that any campaign reaches its goal.
2. Accounts
- Organizers and co-managers must be at least 18 and authorized to raise money for their organization.
- Participants under 18 take part with the permission of a parent, guardian or their school or club. A parent or guardian may be added to manage a participant’s page.
- Keep your login details private. You are responsible for activity on your account.
3. Organizer responsibilities
- Describe the campaign honestly and use the funds for the purpose you describe.
- Only claim nonprofit or tax-exempt status your organization actually has, and keep it current.
- Follow your school’s, district’s or league’s fundraising rules and all applicable laws.
- Have permission for every photo, video, logo and name you upload, including permission to show participants who are minors.
- Deliver any incentives, rewards or sponsor recognition you promise.
4. Fees
Creating a campaign is free. We charge a platform fee of 4% of each online donation, unless a different rate is agreed in writing for your campaign. Card processing fees (currently 2.9% + 30¢ per transaction) are charged by the payment processor. At checkout donors may choose to cover the card fee and/or the platform fee; any fee not covered is deducted from the funds paid to the organization. We never ask donors for a tip. We will give at least 30 days’ notice before changing our standard fee, and changes don’t apply to campaigns already running.
5. Donations and payouts
- Donations are made to the organization running the campaign. Whether a gift is tax-deductible depends on the organization’s status and the donor’s situation; receipts state whether nonprofit status has been verified.
- Payouts: [How and when organizations are paid]
- Refunds: donations are generally final. If a donation was made in error (for example, the wrong amount or a duplicate gift), contact the organization or us. Until the organization's payout is sent, we can refund all or part of the gift to the original card, and we email the donor when it's done. After the payout is sent, the money is with the organization, so refunds come from them. The platform fee is figured on what the organization keeps after a refund. The card processor does not return its processing fee on a refund, and that cost is taken from the organization's payout. We may refund donations or hold funds where we suspect fraud.
6. Text message terms
HooRaise sends campaign text messages, such as a kickoff message, weekly reminders and a last-day message, to people who are added as potential donors or who take part in a campaign.
- Consent. If you add someone’s mobile number, you confirm they know you and are happy to hear about your fundraiser. Donors can also add their own number at checkout.
- How often. Message frequency varies by campaign length, usually one message a week and no more than 8 reminders per campaign. Messages stop once you donate or the campaign ends.
- Cost. Message and data rates may apply.
- Opt out. Reply STOP to any message to stop all texts from HooRaise, for every campaign. Reply START to receive them again.
- Help. Reply HELP or email support@hooraise.com.
- Carriers are not liable for delayed or undelivered messages.
- See our Privacy Policy. We do not sell or share mobile numbers for marketing.
7. Your content
You keep ownership of what you upload. You give us permission to host, display and share it in order to run and promote your campaign. We may remove content that breaks these terms.
8. Things you may not do
- Raise money for anything illegal, misleading, hateful or unrelated to the organization.
- Send messages to people who haven’t agreed to hear from you, or upload contact lists you bought or scraped.
- Interfere with the platform, other people’s accounts, or our payment systems.
9. Ending your account
You can stop using HooRaise at any time. We may suspend or close accounts or campaigns that break these terms, and hold funds where needed to address fraud or donor complaints.
10. Disclaimers and limits
The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. [Have a lawyer finalize this section.]
11. Governing law
These terms are governed by the laws of [State], without regard to its conflict-of-law rules.
12. Changes
We may update these terms. If changes are important, we’ll update the date at the top and let account holders know by email before they take effect.
